Introduced by Rep. George Cushingberry (D) on May 15, 2007, to authorize consumer lawsuits against a credit reporting agency that has an incomplete or inaccurate item of information. The consumer could not sue until he or she has undertaken the dispute resolution procedures specified under federal law. A district court could award any damages authorized by the federal “fair credit reporting act,” which include a maximum of $1000 in statutory damages, plus actual damages and punitive damages.
