2012 House Bill 5410

Assert federal regulatory overreach of intra-state food products

Introduced in the House

Feb. 16, 2012

Introduced by Rep. Tom McMillin (R-45)

To assert that food products produced in Michigan and which remain in Michigan are not subject to federal regulations (under authority claimed by congress under the constitution’s interstate commerce clause). The bill explicitly claims a 10th Amendment state immunity from federal food regulations, and would prohibit any federal, state or local officials from enforcing food regulations in Michigan.
