2012 House Bill 5523: Ban employers or schools asking for Facebook passwords (Senate Roll Call 888)

Passed 38 to 0 in the Senate on December 12, 2012, to prohibit employers and schools, colleges and universities from requesting or requiring employees or students to disclose their social networking account passwords, login information or other security information, subject to penalties up to 93 days in jail and a $1,000 fine, plus lawsuit liability. An employee could be disciplined or fired for transferring the employer's proprietary, confidential or financial information to a personal internet account.

There are many other questions that are illegal for employers to ask or for schools to ask a student. It is important to recognize these questions, and to know how to respond if you are ever asked one. There are pros and cons about answering and not answering an illegal question.

Totally agree with HB 5523. I hope it takes immediate effect. It is none of an employers or a school districts business what someone's password is and they have no business either requesting or mandating someone to give it to them. Asking for someones Facebook password violates an individual's privacy.
