2004 House Bill 5438

Insurance requiring mail order drug sale regulations

Introduced in the House

Jan. 27, 2004

Introduced by Rep. Paula Zelenko (D-50)

To prohibit health insurers, HMOs, and other health plans from paying different amounts for prescription drugs to different pharmacists, or requiring different co-pays or deductibles, whether they sell by mail order or over the counter, as long as the pharmacist agrees to the terms of the insurance policy or plan. The bill would also prohibit the insurer from limiting the number of days’ supply of drugs that insured could obtain at any one time. It is part of a package comprised of House Bills 5435 to 5438, and 4987, which would also impose Michigan pharmacy licensure requirements and regulations on out-of-state pharmacies that sell to customers here by mail order.
