2006 House Bill 5751

Provide tax subsidy for gasohol and biodiesel

Introduced in the House

Feb. 23, 2006

Introduced by Rep. Philip LaJoy (R-21)

To lower the gas tax on gasoline that contains 85 percent ethanol from 19-cents to 12-cents per gallon, and on diesel fuel that contains 5 percent biodiesel from 15-cents to 12-cents per gallon. Note: Only "flex-fuel" vehicles can use 85 percent ethanol.

Referred to the Committee on Agriculture

March 1, 2006

Reported without amendment

With the recommendation that the substitute (H-2) be adopted and that the bill then pass.

March 15, 2006

Substitute offered

To replace the previous version of the bill with one that revises details but does not change the substance of the bill as previously described.

The substitute failed by voice vote

Amendment offered by Rep. Neal Nitz (R-78)

To replace the previous version of the bill with one that allows the lower tax on fuel that is 70 percent ethanol, rather than 85 percent ethanol. In colder months flex fuel vehicles do not run well on 85 percent fuel.

The amendment passed by voice vote

Amendment offered by Rep. Kathleen Law (D-23)

The amendment failed 48 to 57 (details)

Amendment offered by Rep. Paul Condino (D-35)

To tie-bar the bill to House Bill 5120, meaning this bill cannot become law unless that one does also. HB 5120 would mandate that all diesel fuel sold in Michigan contain at least 5 percent biodiesel if the Department of Agriculture certifies that Michigan producers have the “capacity” to produce at least 12 million gallons annually.
