To establish sentencing guidelines for the new felony proposed in House Bill 5156, which makes it a crime to sell an essential commodity during an emergency declared by the governor at a price greater than 10 percent above the prevailing price for comparable goods before the declaration of an emergency, notwithstanding actual supply and demand factors, except that an increase in the supplier’s cost may be factored into the sale price.
