To make it a felony to sell an essential commodity during an emergency declared by the governor at a price greater than 10 percent above the prevailing price for comparable goods before the declaration of an emergency, notwithstanding actual supply and demand factors, except that an increase in the supplier’s cost may be factored into the sale price.
