To exempt a health facility from the requirement to get state Certificate of Need Commission (CON) approval for the relocation of licensed beds from one existing health facility to another located in the same health service area, if the relocation does not result in an increase of licensed beds or the initiation, expansion, or replacement of a CON-covered clinical service within that health service area. The state “certificate of need” program limits the availability of health care facilities and technology by requiring health care providers to seek permission from a state commission for new or expanded facilities, or to add certain pieces of capital-intensive equipment (such as MRI machines, etc.).
