To increase from 21 days to 90 days the amount of time that the legislative Joint Committee on Administrative Rules (JCAR) has to object to new administrative rules proposed by executive branch agencies and departments. If JCAR objects to a rule as provided by law, the bill authorizes the committee to refer proposed rules to the attorney general for an opinion on whether they are legal or conflict with other state laws. Also, the bill would allow a simple majority of the committee, rather than a majority of the committee members of each chamber, to object to a rule. Under current law, if JCAR objects to a rule, a bill to stop or postpone it is introduced and automatically placed on the legislative calendar. The bill would add to this the option to introduce legislation to amend or limit the application of a new rule.
