To allow a plaintiff in a medical malpractice case to recover economic and non-economic damages in proportion to the loss of opportunity to survive or achieve a better result that was proximately caused in whole or in part by the alleged malpractice. Under current law a plaintiff cannot recover damages unless the chances to survive or to achieve a better result were greater than 50 percent.
