To create a new health care information protection and privacy act which imposes restrictions on the disclosure or sharing of a person’s health information. This would prohibit disclosing a patient's health care information without written consent from the patient or his or her authorized representative. Disclosures specifically allowed by federal or state laws, rules, regulations, or Medicaid policies would be exempt. Consent forms would have to be "specific to a particular disclosure," with blanket forms prohibited. Health care information that identified a patient could not be sold, or transferred for use in a commercial solicitation without written consent.
