2005 House Bill 4629

Limit criminal reimbursement orders

Introduced in the House

April 19, 2005

Introduced by Rep. Michael Sak (D-76)

To prohibit a court from ordering a person convicted of certain criminal offences to reimburse the state or a local government for its expenses if the defendant would be unable pay the reimbursement during the sentence term. A court would be required to take into account the defendant's financial resources, with due regard to his or her other obligations. A defendant could petition to have such reimbursements waived if they would present a manifest hardship on the defendant or his or her immediate family.
