2005 House Bill 5203

Revise nonconforming structure zoning authority

Introduced in the House

Sept. 21, 2005

Introduced by Rep. Steve Tobocman (D-12)

To give local governments the power to impose a new zoning classification on property that does not conform to the classification after a period of “amortization,” which is not defined in this statute. This statute gives local governments the power to order a nonconforming structure or use to be removed, and to use the power of eminent domain to take nonconforming property.
