To eliminate a provision of the Consumer Protection Act that exempts unfair, unconscionable, or deceptive insurance methods, acts, or practices from lawsuits under the Act. Note: Separately, the Insurance Code provides penalties for unfair, unconscionable, or deceptive insurance methods, acts, or practices. Also, to require that the burden of proof be placed on a person who claims immunity from a lawsuit filed under the Consumer Protection Act because of an exception or exemption in the law. Note: Some activities that have been specifically allowed and regulated under the insurance code might be prohibited under the Consumer Protection Act. This is part of a Democratic insurance regulation package.
