To limit the ability of a divorced parent to limit the granting by a court of a grandparent visitation order. Under current law, there is a "rebuttable presumption" that a fit parent's desire to deny grandparenting visitation does not create a risk to the child. A grandparent seeking to overcome this presumption must show by a preponderance of the evidence that the denial of grandparenting visitation poses a risk to the child. The bill would repeal this presumption, and make other changes that lower the burdens of grandparents in obtaining a visitation order.
