To mandate that all diesel fuel sold in Michigan contain at least 5 percent biodiesel, if the director of the Department of Agriculture reports that producers in this state have the “capacity” to produce at least 12 million gallons annually. “Capacity” is not defined in the bill. The Department of Agriculture would be required to annually report on the state’s biodiesel capacity.
