To establish procedures for a juvenile who commits a crime and is deemed not competent due to mental illness, serious emotional disturbance or developmental disability, but whose competence the court determines could be “restored” with treatment. Under the bill minor crimes would be dismissed, serious misdemeanors could be either dismissed or suspended pending restoration of competence at the discretion of the court, and the trial for serious crimes would be suspended pending restoration of competence, with no court discretion. The bill is part of a juvenile criminal trial competency rules and procedures package comprised of House Bills 5482 to 5489.
