To require all employers to adopt policies that include procedures for reporting, investigating, and remedying allegations of abusive conduct that creates an “abusive workplace environment,” defined as “work environment in which an individual, acting with malice, subjects an employee to abusive conduct severe enough to cause tangible harm.” (“Tangible harm” is not defined.) Employers who fail to adopt and enforce such a policy would be open to being sued by employees who allege the existence of an “abusive workplace environment”.
