To establish that if a putative father files a petition seeking to have his paternity established in law and the mother does not respond, a court must declare the man to be the father (issue an “order of filiation”). If the father then petitions for custody and the mother does not seek to have the order of filiation set aside, the court must grant custody, unless it determines this presents a reasonable likelihood of harm to the child.
