2011 Senate Bill 701

Ban contracts that use foreign law

Introduced in the Senate

Sept. 27, 2011

Introduced by Sen. Roger Kahn (R-32)

To violate individual rights to prohibit a court from enforcing a contract provision that relies on a foreign law to govern disputes between the parties if this violates a right of an individual recognized by the U.S. constitution. This would not apply to a corporation that subjects itself to foreign law in a jurisdiction outside the U.S.
