To place the burden of proof on property owners that improvements and construction on land deemed to be a “critical sand dune” complies with the extensive regulatory permit requirements and restrictions that state law currently imposes on such projects. Under current law, the burden is on the state or a local government to provide information in a permit denial showing that a project will not comply with these regulations. The bill would also allow local governments to impose their own restrictions and requirements that exceed state law.
