2017 House Bill 4766

Expand court powers over government Open Meetings Act scofflaws

Introduced in the House

June 14, 2017

Introduced by Rep. Martin Howrylak (R-41)

To expand the grounds under which a person who complains about a government body’s violation of the state Open Meetings Act can recover costs and attorney fees. The bill would authorize court injunctions to compel compliance or enjoin non-compliance, empower courts to issue a “declaratory judgement” that a violation has or is occurring, and also move these actions to the state court of claims.
