2018 House Bill 5396

Require conviction for some expedited tenant evictions

Introduced in the House

Jan. 11, 2018

Introduced by Rep. Pete Lucido (R-36)

To revise a law that enables a landlord to a obtain a “summary” eviction order on a tenant who is manufacturing illegal drugs on the premises, so it would allow expedited evictions for dealing or possessing drugs, but only if the tenant has been convicted. Also, to amend a provision that permits an expeditious eviction if the tenant has “caused or threatened physical injury to an individual” on the property, by also making this conditional on the tenant having been convicted.
