2021 House Bill 4118

Create process for disclosing prison and jail guard firing to other agencies

Introduced in the House

Feb. 3, 2021

Introduced by Rep. Ben Frederick (R-85)

To extend to corrections officers the terms of a 2017 law that established a process and liability exemptions for a police agency disclosing information to another agency about a formerly-employed officer who may have been fired. The process includes letting a separating officer review the record and make his written explanation a permanent part of it. Applicants must give the prospective employer a waiver allowing it to get the records explaining the separation, and the former employer is immune from liability for revealing this.
