To revise not eliminate the sunset on the .08 BAC threshold. Under current law, on Oct. 1, 2021 the limit reverts to a previous level .10 grams per 100 milliliter. Under the bill, that will happen five years after the state treasurer certifies no federal highway funding is conditioned on compliance with a national blood alcohol limit. The .08 limit was originally imposed by the federal government as a condition of state’s getting a share of federal gas tax and other road money.
