A bill to amend 1846 RS 66, entitled “Of estates in dower, by the curtesy, and general provisions concerning real estate,” by amending the title and sections 35 and 36 (MCL 554.135 and 554.136) and by adding section 36a.
The bill aims to regulate the acquisition and ownership of land by aliens, allowing them to acquire, hold, convey, and mortgage land with the same rights as native citizens, except as specified in section 36a. Section 36a introduces restrictions on the purchase or acquisition of farmland in Michigan by foreign governments, state-sponsored enterprises, or individuals acting on their behalf, effective from the date of the amendment. However, those who owned or held farmland before October 1, 2023, are allowed to maintain ownership but cannot acquire additional farmland. Exceptions are made for acquisitions under U.S. treaties.
