2023 House Bill 4186 / 2024 Public Act 55

Construction: asbestos; provision allowing the withholding of payment to asbestos abatement contractors or demolition contractors for environmental violations; require certain local government contracts to contain, and require certain disclosures by asbestos abatement contractors and demolition contractors.

An act to allow local governments and certain authorities to withhold payment under certain conditions to contractors on an asbestos abatement project; to provide for mandatory contract conditions on certain asbestos abatement projects; to provide for certain disclosures; and to prescribe the powers and duties of certain local officials.

House Fiscal Agency Analysis

House Bills 4185 to 4190 would create new acts and amend several existing acts relating to the regulation of asbestos handling and removal activities and how public entities may enter into contracts and agreements with contractors engaging in those activities. Broadly speaking, the bills would add requirements regarding which entities may enter into agreements with public entities for certain asbestos abatement activities and conditions under which an entity would either be eligible or ineligible to enter into a contract.
