A bill to amend 1994 PA 451, entitled “Natural resources and environmental protection act,” by amending section 8905a (MCL 324.8905a), as amended by 2014 PA 549.
The bill introduces a tiered penalty system for littering offenses based on the volume of litter, with penalties ranging from state civil infractions and fines up to $800 for less than 1 cubic foot of litter, to misdemeanors with fines up to $10,000 for second offenses involving 5 cubic yards of litter or more. Employers can be held accountable for violations committed with their knowledge or direction. The bill mandates litter removal and property remediation by offenders, allows for enhanced fines for repeat offenders, and requires violators to reimburse local groups or governmental departments for cleanup and remediation efforts.
