Health: code; individuals receiving a sexual assault medical forensic examination; allow to shower at the medical facility following the examination.

A bill to amend 1978 PA 368, entitled “Public health code,” by amending section 21527 (MCL 333.21527), as amended by 2014 PA 320.

House Bill 4490 would amend section 21527 of the Public Health Code, which requires a doctor or other attending or admitting hospital staff member who is told by an individual that the individual was the victim of criminal sexual conduct within the previous five days to inform the individual about the availability of a sexual assault medical forensic examination, including the administration of a sexual assault evidence kit. The doctor or staff member must perform the forensic examination, if the individual consents, and must let the individual know that 1976 PA 223, the crime victims compensation act, provides for payment of the examination’s costs. The bill would add that, if the hospital has a shower facility, an individual administered a sexual assault evidence kit as described above has a right to access the shower facility at no cost after the administration of the sexual assault evidence kit.
