A bill to amend 1931 PA 328, entitled “The Michigan penal code,” (MCL 750.1 to 750.568) by adding section 335b.
According to the bill, individuals aged 18 or older who knowingly send sexually explicit videos or images to another adult without their consent, or against their explicit wishes, would be committing a misdemeanor punishable by a fine of up to $500. Additionally, victims of such offenses would have the right to pursue civil action against the perpetrator for injunctions, actual damages including emotional distress, and recovery of reasonable attorney fees and costs. The bill defines "nudity" and "sexually explicit video or image" for clarity.
