A bill to amend 1994 PA 451, entitled “Natural resources and environmental protection act,” by amending section 20101b (MCL 324.20101b), as amended by 2000 PA 368.
Clarifies that fiduciaries, such as lenders who assume ownership or control of a property in a fiduciary capacity without directly managing it or engaging in the handling of hazardous substances, are not personally liable under this part of the law. However, it maintains that fiduciaries can still face personal liability for their own negligence, gross negligence, or intentional misconduct.
