A bill to amend 1974 PA 258, entitled “Mental health code,” (MCL 330.1001 to 330.2106) by adding section 469b.
The bill specifies the mediation process, requiring mental health providers to inform recipients of their right to request mediation at the start of treatment and annually thereafter. The Department is responsible for funding and contracting experienced behavioral health mediation organizations. Mediators, who must be trained and impartial, are to facilitate the mediation process, which should start within 10 business days of a request and conclude within 30 days, with a possible 30-day extension. A legally binding agreement is to be drafted and signed if a resolution is reached, enforceable in court. If unresolved, a document stating the dispute must be provided to all parties within 10 business days after mediation ends.
