A bill to amend 1909 PA 279, entitled “The home rule city act,” (MCL 117.1 to 117.38) by adding section 5l.
This bill proposes an amendment to the "The Home Rule City Act," by allowing city legislative bodies to authorize, via resolution, the contracting for maintenance or improvement of private roads within the city through the creation of a special assessment district. Property owners representing more than 50% of the frontage along a private road can petition the city for such maintenance or improvements. Costs would be allocated to all owners in the special assessment district based on a pro rata frontage basis. The process includes the creation of a special assessment district, proper notification, and public hearings before any maintenance or improvement, and the assessment of costs, can proceed. Additionally, the bill specifies that such maintenance or improvement programs cannot exceed five years without the creation of a new special assessment district.
