A bill to amend 1927 PA 175, entitled “The code of criminal procedure,” by amending sections 16d and 16l of chapter XVII (MCL 777.16d and 777.16l), section 16d as amended by 2016 PA 88 and section 16l as amended by 2016 PA 150.
SB 106 and 107 propose making performing a partial-birth abortion, except when the mother's life is at risk, a felony punishable by up to 4 years in prison or a fine up to $50,000, or both. It also allows certain family members to sue if a partial-birth abortion occurs, except in cases where the pregnancy resulted from the plaintiff's criminal conduct or the plaintiff consented to the abortion. Importantly, women seeking partial-birth abortions are not considered conspirators under this law, and it does not create a right to abortion. SB 107 adjusts sentencing guidelines.
