A bill to amend 1927 PA 175, entitled “The code of criminal procedure,” by amending section 16a of chapter XVII (MCL 777.16a), as amended by 2010 PA 97.
SB 108 prohibits performing or attempting to perform an abortion based on a prenatal diagnosis or screening indicating Down syndrome in the unborn child, except in cases where the abortion is necessary to save the life of the pregnant woman due to a life-threatening condition. Violation of this section would be considered a felony, punishable by up to 4 years in prison, a fine of up to $10,000, or both. The pregnant woman undergoing such an abortion would not be held criminally responsible. SB 109 adjusts sentencing guidelines.
