A bill to amend 1990 PA 211, entitled “The parental rights restoration act,” by amending section 7 (MCL 722.907).
SB 115 establishs that performing an abortion in violation of the Parental Rights Restoration Act constitutes a felony, punishable by up to 4 years in prison, a fine of up to $10,000, or both. Additionally, it clarifies that failing to obtain parental consent or a waiver before performing an abortion on a minor is considered prima facie evidence of failing to obtain informed consent or interfering with family relations, and it does not prevent the awarding of exemplary damages in civil actions related to violations of this act. SB 116 adjusts sentencing guidelines.
