An act to amend 1883 PA 98, entitled “An act to punish persons who procure or place upon record spurious or fraudulent conveyances of real estate, with intent to deceive,” by amending the title and section 1 (MCL 565.371).
The legislation amends the 1883 PA 98 statute, which addresses fraudulent real estate conveyances, by expanding its scope and updating its provisions. The primary objective is to prohibit individuals from procuring or placing fraudulent real estate documents on record with the intent to deceive. Additionally, it introduces a prohibition against drafting or submitting fraudulent documents to the register of deeds. The penalties for such offenses have been revised: individuals found guilty of recording fraudulent real estate documents with intent to deceive can face up to three years of imprisonment, a fine of up to $5,000, or both. A new provision stipulates that knowingly and willfully drafting or submitting a fraudulent document with the intent to defraud the owner of real estate or an interest in real estate is punishable by up to ten years of imprisonment, a fine of up to $5,000, or both. The legislation also empowers the register of deeds to provide evidence of suspected violations to the county prosecutor.
