A bill to amend 1956 PA 40, entitled “The drain code of 1956,” by amending section 514 (MCL 280.514), as amended by 2006 PA 16.
This bill establishes the composition and appointment procedures for drainage boards responsible for overseeing drainage projects. These boards are to include the director of the Department of Agriculture and Rural Development and the drain commissioners from each county involved in the project. In cases where a project involves a county with an appointed drain commissioner and a population exceeding 1,000,000, additional representatives from affected municipalities will be appointed to the board. The bill also addresses scenarios involving two counties with specific organizational and population criteria, detailing the inclusion of elected officials or their designees from cities subject to assessment for the project. The appointed municipal representatives are to serve two-year terms, with provisions for the appointment of successors should an appointee be unable to serve. Certain exceptions to these rules are outlined, particularly for projects in counties with populations over 1,000,000 organized under specific public acts.
