A bill to amend 1931 PA 328, entitled “The Michigan penal code,” (MCL 750.1 to 750.568) by adding sections 410d, 410e, and 410f.
The bill targets aliens entering or attempting to enter Michigan from a foreign nation at non-legal ports of entry, making such actions misdemeanors with penalties of up to 6 months in prison. Repeat offenses escalate to felonies, with imprisonment ranging from 2 to 20 years. The legislation provides affirmative defenses for individuals with lawful presence, asylum, or DACA status but excludes those under the Deferred Action for Parents of Americans and Lawful Permanent Residents program or similar non-Congress enacted programs. Additionally, the bill penalizes aliens in Michigan who have been denied admission, deported, or removed from the U.S., with the severity of charges based on prior convictions and the circumstances of their removal. Aliens failing to comply with court orders to return to their country after being charged or convicted under section 410d face felony charges, also punishable by 2 to 20 years in prison.
