2024 House Bill 5821

Crimes: penalties; penalties for discharging a firearm at a motor vehicle; increase fines if a minor is in the vehicle.

A bill to amend 1931 PA 328, entitled “The Michigan penal code,” (MCL 750.1 to 750.568) by adding section 234g.

Mackinac Center Analysis

HB 5821 and HB 5822 create new sentencing guidelines for a person convicted of discharging a firearms at a motor vehicle. Such an act would be a Class D felony punishable by up to 10 years in prison and/or a fine of up to $10,000. However, if the motor vehicle fired upon contained a minor, the offense would be upgraded to a Class B felony and the maximum punishments would double.
