A bill to amend 1927 PA 175, entitled “The code of criminal procedure,” by amending section 16m of chapter XVII (MCL 777.16m), as amended by 2018 PA 637.

HB 5821 and HB 5822 create new sentencing guidelines for a person convicted of discharging a firearms at a motor vehicle. Such an act would be a Class D felony punishable by up to 10 years in prison and/or a fine of up to $10,000. However, if the motor vehicle fired upon contained a minor, the offense would be upgraded to a Class B felony and the maximum punishments would double.
