A bill to amend 2008 PA 295, entitled “Clean and renewable energy and energy waste reduction act,” by amending the title and section 13 (MCL 460.1013), as amended by 2023 PA 235; and to repeal acts and parts of acts.
The bill mandates that electric service providers establish and recover costs for renewable and clean energy programs, and that providers of electric or natural gas services do the same for energy waste reduction programs. It ensures that the costs and savings from these programs are factored into rate determinations and authorizes the use of specific energy systems to meet program requirements. It also establishes a wind energy resource zone board with defined powers and duties, authorizes the creation and implementation of wind energy resource zones, and provides for expedited transmission line siting certificates. The legislation includes provisions for customer generation and net metering programs, detailing the responsibilities of electric service providers and customers, and prescribes fees, powers, and duties for state agencies and officials. It requires the promulgation of rules and issuance of orders, and authorizes the establishment of residential energy improvement programs by electric or natural gas service providers. The bill also outlines civil sanctions, remedies, and penalties.
The bill specifies that a "site" refers to a contiguous area regardless of the number of meters, and defines a "transmission line" as all necessary structures, equipment, and real property for transferring electricity at a bulk supply voltage of 100 kilovolts or more. It introduces the "utility system resource cost test" to evaluate the cost-effectiveness of energy waste reduction investments, and defines a "wind energy conversion system" as one or more wind turbines generating at least 100 kilowatts of electricity. A "wind energy resource zone" is designated by the commission under section 147.
Enacting section 1 repeals Part 8 of the 2008 PA 295 (MCL 460.1221 to 460.1232). Enacting section 2 stipulates that the amendments will not take effect unless Senate Bill No.____ or House Bill No. 5858 of the 102nd Legislature is enacted into law. The bill outlines significant changes to existing energy regulations, aiming to enhance renewable energy adoption and energy efficiency, impacting various stakeholders including service providers, state agencies, and the public.
