A bill to amend 1927 PA 175, entitled “The code of criminal procedure,” by amending section 16w of chapter XVII (MCL 777.16w), as amended by 2016 PA 486.

HB 5864 amends references in the state's criminal sentencing guidelines from "prostitution" to "commercial sexual activity." It creates a 5-year maximum sentence for commercial sexual activity with a person less than 18 years of age, and a 4-year maximum sentence for a third or subsequent conviction for commercial sexual activity. It is tie-barred to the passage of HB 5841.
