A bill to amend 2000 PA 92, entitled “Food law,” by amending section 4105 (MCL 289.4105), as amended by 2016 PA 188.
Senate Bill No. 882 (2024), introduced by Senator Singh, aims to amend the Michigan Food Law by designating maple syrup and honey producers as limited food processors. This legislation proposes exemptions from licensure requirements for a variety of entities, including but not limited to:
Establishments licensed under specific acts. Sellers of whole uncut fresh fruits and vegetables. Nonprofit cooperatives. Retail outlets for prepackaged honey or maple syrup. Temporary food establishments with no food preparation. Mobile food establishments offering only prepackaged, single-serving frozen desserts. Nonprofit trade association events not open to the general public where limited food preparation occurs. Commercial fishing guide services serving lunch to clients during fishing activities. Operators of vending devices dispensing bottled or canned soft drinks, packaged nonperishable foods or beverages, or bulk items like gum, nuts, and candies. Feeding operations established in response to emergencies or disasters. Food warehouses or processors handling only uncut fruits or vegetables under specific conditions, such as being owned and operated by the producers, with activities limited to storing, grading, sorting, packing, washing, trimming, and refrigerating the produce. This bill seeks to simplify the regulatory requirements for these entities, potentially reducing the burden on small-scale food producers and sellers while maintaining food safety standards.
