A bill to amend 1909 PA 279, entitled “The home rule city act,” (MCL 117.1 to 117.38) by adding section 5l.
Senate Bill No. 896 seeks to amend the Home Rule City Act of 1909 by adding section 5l. This amendment would enable the legislative body of a city to authorize, through a resolution, the contracting for maintenance or improvement of private roads within the city by establishing a special assessment district. If over 50% of the property owners along a private road petition for such work, the city may proceed with the maintenance or improvement projects, with the costs being distributed among the property owners based on frontage. The creation of a special assessment district and proper notification of public hearings are required before any work can commence. Maintenance or improvement programs under this section are limited to a duration of up to five years, with the possibility of renewal through the establishment of a new special assessment district. The term "maintenance" is defined according to section 10c of the 1951 PA 51.
