A bill to amend 1972 PA 230, entitled “Stille-DeRossett-Hale single state construction code act,” by amending section 28 (MCL 125.1528), as amended by 2020 PA 155, and by adding section 4i.
Senate Bill No. 906 aims to amend the Stille-DeRossett-Hale Single State Construction Code Act, specifically targeting section 28 and adding a new section 4i. This legislation focuses on the installation and regulation of temporary door locking devices in child care centers. The bill mandates that these devices must be portable, not permanently affixed, and capable of being operated without the need to open the door. Additionally, it requires that the devices can be unlocked from the outside using a key or tool, do not obstruct fire safety mechanisms, and can be disengaged from the inside without special tools.
For the installation of new devices, child care center operators are required to submit plans for review, obtain necessary permits, notify local fire authorities, and ensure staff are trained on the use of these devices. These devices are to be used only for limited periods, as defined by an emergency procedure plan that complies with licensing rules for child care centers. Existing devices installed before the act's effective date must also meet these standards and receive approval from an enforcing agency.
The bill clarifies that these devices can be installed in any child care center, regardless of the building's size or the cost of construction, without the need for construction documents to be sealed by a licensed architect or engineer. It also states that the act does not conflict with other public acts, including the Michigan fireworks safety act, the natural resources and environmental protection act, the public health code, and the Michigan occupational safety and health act, among others. A fire door assembly with a temporary door locking device installed according to this act is not considered a violation of the law.
The enactment of Senate Bill No. 906 is contingent upon the passage of Senate Bills No. 907 and No. 908.
