A bill to amend 1931 PA 328, entitled “The Michigan penal code,” by amending section 174a (MCL 750.174a), as amended by 2013 PA 34.
The bill addresses the fraudulent, deceitful, or coercive acquisition or use of a vulnerable adult's money or property. It outlines penalties based on the value of the money or property involved and the offender's prior convictions. Penalties range from misdemeanors with fines and short-term imprisonment for amounts under $200, to felonies with longer imprisonment and higher fines for amounts exceeding $100,000 or for repeat offenders. The bill also includes provisions for prosecuting offenses committed after the vulnerable adult's death and allows for the aggregation of values in separate incidents within a 12-month period. Enhanced sentences based on prior convictions must be stated by the prosecuting attorney and determined by the court. Financial institutions and their employees are exempt when performing duties in the normal course of business. The bill allows for consecutive sentencing for certain violations and does not preclude additional charges for other violations of law. Definitions for "broker," "financial institution," and "vulnerable adult" are provided, and the office of services to the aging is required to report violations to the department of health and human services.
