A bill to impose civil liability and prescribe criminal penalties for the nonconsensual creation or dissemination of deep fake sexual images; and to provide for remedies.
HB 4046, 4047 and 4048 creates the "Protection from Intimate Deep Fakes Act" which allows for a civil action for the creation or dissemination of a deep fake (a video recording, sound recording, electronic image, or photograph so real that a reasonable person could construe this was the actual individual) that is done without the person's consent. The other bills establish sentencing guidelines for violating the act and articulates the process for filing a civil lawsuit.
